Suit Against Dunkin Donuts Alleges Angus Steak Isn't Steak
(RTTNews) - Chufen Chen from Queens, New York City, has filed a lawsuit against Dunkin Donuts alleging that the donut chain is cheating customers by selling Angus steak-and-egg breakfast sandwiches while they are actually selling beef patty at a premium.
According to the claimant, customers pay more for the Angus steak and egg sandwich and the Angus steak and egg Snack N' Go wrap products than similar products believing that they contain steak. However, the claimant says that it only contains a beef patty that contains fillers, which is "false, deceptive and misleading" advertising and marketing campaign.
The lawsuit says that "Angus steak is not steak," as the term is defined under 9 CFR 381.162 in the Code of Federal Regulations. The complaint notes that the chain sells the sandwich for 50-60 cents more than the other sandwiches on the menu.
"I believe this is consumer fraud," said Chen's attorney, John Troy. "They try to promote the steak but actually it is not steak. It is a meat patty."
Chen seeks monetary damages as well a restrict Dunkin' Donuts from "inaccurately describing, labeling, marketing, and promoting" its products as containing steak.
